1. Introduction & Acceptance

These Terms of Service ("Terms") govern your access to and use of the LeaveKit website, mobile application and related services (collectively, the "Service"), operated by LeaveKit Ltd ("we", "us", "our").

By creating an account or using the Service in any way, you agree to be bound by these Terms. If you do not agree, you must not use the Service. Continued use after any updates to these Terms constitutes acceptance of the revised version.

2. Description of the Service

LeaveKit is a staff leave management SaaS platform that enables organisations to manage employee leave requests, approvals, allowance tracking and team visibility. The Service is accessed via a web application at leavekit.com and a companion mobile application.

Features include, but are not limited to, leave request and approval workflows, annual leave allowance tracking, public holiday calendars, department-based organisation structures, and reporting tools. We reserve the right to modify, suspend or discontinue any part of the Service at any time with reasonable notice.

3. User Accounts & Responsibilities

You are responsible for:

• Providing accurate account information (name, work email address) during registration.
• Maintaining the confidentiality of your password and login credentials.
• All activity that occurs under your account, whether authorised by you or not.
• Notifying us immediately of any unauthorised use of your account at security@leavekit.com.

Workspace owners are responsible for configuring their organisation's leave policies, approving or rejecting leave requests, and managing user access within their workspace.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to gain unauthorised access to any part of the Service, other accounts, or computer systems.
• Interfere with or disrupt the integrity or performance of the Service (e.g. through malware, scraping, denial-of-service attacks).
• Use the Service to store or transmit any content that is infringing, defamatory, or otherwise harmful.
• Reverse-engineer, decompile or extract the source code of the Service, except as permitted by applicable law.

5. Intellectual Property

The Service, including its code, design, logos, trademarks, and content, is owned by LeaveKit Ltd or its licensors and is protected by copyright, trade mark and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms. No other rights are granted. You may not copy, modify, distribute, sell or lease any part of the Service without our prior written consent.

Any feedback, suggestions or feature requests you provide may be used by us without obligation or compensation to you.

6. Limitations of Liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose or non-infringement.

To the fullest extent permitted by applicable law, LeaveKit Ltd shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data or business opportunities, arising out of or relating to your use of the Service.

Our total liability to you for any claim arising from these Terms or the Service shall not exceed the total fees paid by you in the twelve (12) months preceding the event giving rise to the claim.

7. Termination

You may terminate your account at any time from within the app settings. Upon termination, your data will be deleted or anonymised in accordance with our Privacy Policy within a reasonable period, subject to any legal retention obligations.

We reserve the right to suspend or terminate your access to the Service immediately, without prior notice, if you breach these Terms or if your use of the Service poses a security risk or legal liability to us or other users.

8. Privacy

Your privacy matters to us. Please read our Privacy Policy to understand how we collect, use, store and protect your personal data. The Privacy Policy is incorporated into these Terms by reference.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified to you via email or through the Service. The date at the top of this page reflects the latest revision. Continued use of the Service after changes take effect constitutes your acceptance of the new Terms.
